Enduring Powers of Attorney

Many people believe these documents are for the elderly or for those with illnesses such as dementia, whereas the reality is that these documents are incredibly important for everyone to have at any age.  If you were to have an accident or an illness which resulted in a medical professional stating that you were no longer capable of managing your own affairs by reason of mental disorder, you legally lose your right to make decisions or sign for anything.  Without an Enduring Power of Attorney in place, in the event of your mental incapacity your family would need to apply for a Mental Health Receivership through the Courts, which is complex, costly and can cause significant stress to your loved ones.

We hope that none of our clients will ever require these documents and whilst you have mental capacity, they will remain dormant in safe custody; however, should you have an accident or an illness, your family will be very relieved if you have an Enduring Power of Attorney in place.

 

By making an Enduring Power of Attorney you can select who would be your appointed attorneys and in control of your personal and financial affairs in the event that you should no longer be capable of managing such affairs by reason of mental disorder.   These powers can also be useful in the event of a long-term illness or other incapacity.
